Judges Watch Out Protestors Say

A departure from sentencing guidelines has another Shawnee County District Court Judge facing criticism. Protestors stood outside the Courthouse Thursday, angry, over Judge Matthew Dowd’s decision last month to sentence a man convicted of raping a minor to 3 years probation.

These protestors are letting their signs speak for them and hoping Shawnee County judges get the message.

"Let them know that they're appointed and they've been gifted their jobs from years of service and now it's time to show they deserve to keep their jobs," says Monica, protest organizer.

This protest centered around 14-year-old Brandi Burlison, the victim of 38-year-old Orlando Paul Cisneros, who was sentenced to 3 years probation in May for rape, sodomy and indecent liberties against Brandi. She shows her face Thursday to help others.

"This is her choice. She wants to speak for victims, children who might not have to go through this because judges will put sex offenders behind bars. Because if they let them out on probation, it's going to happen again," says Tina Burlison, victim's mother.

"If they deserve to go to jail, then send them to jail. I think this case was unfair because he should've gone to jail," says Brandi.

Through therapy she is recovering, but says Judge Dowd’s decision has left her with fear.

"Now I'm scared because he's out. He could be around the corner, you never know," says Brandi.

She says the judge justified the probation because Cisneros was depressed, sending a bad message to criminals.

"That it's okay to do this, just say you're depressed and you can get out of jail because that's what happened here," says Brandi Burlison.

"Judge Dowd also said that he had steady employment, well so did the BTK killer, what’s his point?" says Monica.

Even District Attorney Bob Hecht has called Judge Dowd’s decision "incomprehensible" and Hecht’s daughter was at Thursday’s protest. Now Hecht’s office is filing an appeal to Judge Dowd’s decision.

When the crime occurred Brandi Burlison had just turned 14. Had it happened 6 days earlier, when she was still 13, Cisneros could've been sentenced to a mandatory 25 years under Jessica’s Law.
