A twice-convicted Kansas rapist who was never registered as a sex offender has been arrested in another sexual assault in Topeka.

Shawnee County Department of Corrections records show that Hayes was booked on Monday around 4:20 a.m. on suspicion of rape in one case, and aggravated burglary and misdemeanor sexual battery in another case.

According to Kansas Department of Corrections records, 58-year-old Billy Jack Hayes spent 40 years for convictions including rape and burglary at multiple prisons around Kansas. He was most recently released on parole from the Winfield Correctional Facility in September 2018.

Kansas Bureau of Investigation spokeswoman Melissa Underwood said Hayes is not a registered sex offender because he was convicted of rape in 1985, before the Kansas Sex Offender Registration Act was passed in 1994. Underwood said there is currently no process to register offenders for convictions prior to that act’s passing. However, if Hayes is convicted of the most recent charges, he will be added to the registry.
